Citizenship and permit in case of divorce

Silvan0

@lilidoux She says that what happened to her was 19 years ago and it took a lot of struggle to get citizenship, but she succeeded with the help of a lawyer and the ministry of family welfare: . The laws have changed now and it should be much easier for you to get citizenship since your child is a minor. I also have a Mauritian friend who is a militant for women' rights. She is currently away but she will return by the end of the month. I will ask her for extra tips when she's back.

Hi -I need some advises please.

I am a foreigner Married to a Mauritian and living in Mauritius for last six years and stayed in one roof -Applied for my Citizenship 2 years back and still waiting -But unfortunately my marriage is not working -My son from first husband is studying here -i am working in Mauritius -as per the law spouse married to a Mauritian on 2018 is exempted from work permit , I had tough time with my husband and now he is filing a divorce case -I am just stressed that if he files a case will my son education be spoilt. Does he have to stop his education. Can i still fight for my citizenship for him to continue his studies as he is still a minor.. I will be very much grateful if i can get some advise on this on how to go with it..

@Fat Akber

Hello,

If your Mauritian spouse files for divorce before your citizenship is granted, the authorities may refuse the application, because one of the requirements is that the marriage is still subsisting up to the point of approval.

In that case, you will need a work permit or occupation permit to stay here and your son as dependent.

Please talk to a local lawyer he will provide accurate information or contact the Prime Minister’s Office – Citizenship section.

@Bhavna

Thank you once again for your response.

I truly appreciate the advice, and I will reach out to the relevant offices as suggested. However, I just want to express that despite living in Mauritius for over 7 years — which is a significant amount of time — I still find myself without any legal status or basic rights. It’s been incredibly challenging and, at times, disheartening.

I understand the legal process must be followed, but it does feel unfair to remain in this position after so many years of trying to build a life here.

Still, I’m holding on to hope and doing my best to find the right support to move forward
