Employer not willing to cancel my EP

Manushi

Hi Everyone,

I got my EP approved on 1st July 2019 and it is valid till 1st July 2020. I am working on a contractual role which states that if client ends the contract then my contract will be ended with my employer.

As per my contract either party can terminate the contract by serving 1 month notice or paying 1 month’s salary. I have resigned from my job and already serving notice period.

My employer is not accepting my resignation as he is saying we have full authority to approve or reject your resignation. However, I don’t understand this term rejecting the resignation.

He is not replying on my resignation email and not providing me tax clearance documents along with NOC.

Please help me about as I am not aware whom to contact in order to resolve this issue as I am doing everything as per my contract and still he is forcing me to work with him as I am his only employee and Malaysia and if I resign then he will loose his complete business from Malaysia.

Please advise whom should I contact for help.

Thanks,
Manushi

It is strange. I just posted the same question few minutes back.

I am wondering if your employer is the same as mine. I also have a 1-year permit on contract. Why do they do this is completely confusing.

Even i find my current employer very mysterious. These are 4 guys who own this company and all are operating from Hyderabad. I contacted the HR who sits in Malaysia office and she refused to help me as she doesn’t have authority to accept my resignation.

I asked few people to help me out and they asked me to report to MDEC or Indian embassy in Malaysia but not work who can really help us in this issue.
