EP rejected (on being head hunted)

Wanted to share my case:

My EP got rejected today. These were the reasons given as the exact words were shared by HR:

1. You have to advertise this job vacancy at MyCareersFuture.sg for at least 28 days before you can apply for an Employment Pass/ S Pass. Then, if you still wish to employ this candidate after you have considered all applicants fairly, please tell us the Job Posting ID.

2. There was a significant change in the candidate's salary compared to their past salaries. We need to ensure that you will be paying the salary and be convinced that the salary for the candidate is justified. For renewals, please show us proof of the actual salary paid to the candidate in the last 3 months. It will help your case if you can submit documents to show your company has the finances or other means to sustain your business operations, including your employees' salaries.

If I am right in understanding on what MOM needs:
#1 - Startight forward JOB id (active for atleast 28 days)
#2 - Since mine is a new application, the company needs to show documents of finances.

(Please let me know if I am missing anyting here on what MOM needs to process my application)

Few questions around these 2 points stated by MOM:
#1 I was headhunted by the  new company through LinkedIn. Hence not sure if they had advertised the job for 28 days and have job id. I have asked them about it. The company has about 10 employees in Singapore I guess. My understanding was companies with low employee counts need not go through this step right? Please correct me.
on #1, if the company did not post the job on mcf.sg before head hunting me - I have a feeling they might do it now and wait 28 days before making an appeal so they can share a job id with MOM. If they do that, how reliable will my offer be then?

#2 I got salary hike of +33.2%. the reason being the new company does not have a significant variable component vs my current company. On including the variable component of my current company (which i used for negotiating) - the salary hike is about +15%. But still on #2 - MOM is expecting documents from the company right?

About my case:
I am in singapore since 2013 holding masters degree from NUS and never had my EP rejected so far. I am worried if this rejection will affect my future cases on the long run.

Date Applied: 29/09
Rejected: 07/10
Industry: Data Analytics, Marketing, Technology

The last 2 jobs (including current one) , I stayed for 5 years (3 in previous and 2+ in current).

Your advise would be really helpful.

@beppi @surya2k Any advice here please?

#1 - MoM's answer indicates that the company needs to (and didn't) advertise the job on the locals-only jobs bank first and must seriously consider hiring any suitable applicant there. Thus your job offer is not certain - and you must wait 28 days.
#2 - In addition to documentation that the company can and will pay your high salary, MoM expects a justification why this amount is warranted for you. (Hint: Best if your presence helps them to grow and create more local employment.)

@beppi Thank you for the points.

They had already appealed with the finance supporting documents alone. Simultaneously they have posted the job in mycareersfuturesg 2 days ago (3 applicants so far). My thoughts would be that this appeal might be rejected as the job id wasnt provided this time and it has not become 28 days.
Post 28 days - if they still could not find a candidate there. Can they appeal again with the job id now?

Also, would this rejection affect my future applications in any way? Given this was never my fault here.

@beppi please advice.

Karthikk10: The company is not allowed to offer a job to a foreigner before it has been posted on the jobs bank for a month (without suitable local candidate applying). Your employment contract with the company is thus invalid. No appeal can change that.
After completion of the posting (if no suitable local candidate was found), the company can offer you the job and apply for your EP. Then MoM decides whether you can be hired.
I don't think an unsuccessful EP application would have a negative impact on future ones.

The HR mentioned to me that it has past 28 days since they posted the job and have shared the job id in the appeal they made to MOM. You mentioned it is better to apply a new EP application instead of appealing the rejected EP application applied by them before posting the job.

On checking my careers future on the job they posted, the job had 2 applications in total in the website.

What would you advise me do in this case? Should i ask the HR to withdraw appeal and start a fresh application with job id and company reasoning to employ me?

A fresh application with the job id would be a wiser move, keeps it clean.

The company applied for a new application on 18/11 and I got it approved 6/12.
