Married a Vietnamese, no stimulus check for me?

US citizen, I'm married to a Vietnamese, I file US taxes, the IRS has my bank info. I added my wife as dependent as required by US law years ago. When I did so, she got an ITIN number automatically from IRS.

I haven't received my $1200. I was thinking a bank number fail.
But maybe the reason is because I fall into a strange exclusion: an American citizen who is married to a foreign national who has an ITIN but not a social security number, is excluded from the payout.

Anyone else in this category receive their payment? Must be a few 做厙輦⑹s out there like this, haven't seen any other posts.泭 :/

Yup! I'm in the same boat. Some guy in Chicago has already filed a lawsuit.
It is obviously not fair ... ***
I guess all we can do from here is wait and see what happens.

That second exception could give some couples a chance to file their taxes separately, given that the 2019 filing deadline has been pushed back to July 15. However, many taxpayers have already filed their returns for 2019. "

Just a suggestion guys, if after you do the math and it's more my money, file a 1040X replacement for your 2018 or 2019 tax return excluding your wife and file married filing single. Again only if it's worth it.

A good suggestion but you will need to do a lot of work and really watch the numbers.泭 "Married filing separately" is usually the worst filing status and may cost you more than $1200 in extra taxes, depending on your income.泭 Not sure about this, but I would think too that if you modify your filing status on Federal, your state has to match which could raise your taxes even more.

Has nothing to do with "fairness" or lack thereof. I receive SS . And since I am self employed I file taxes yearly. I have not received a check as of 4/29. And, not one friend of mine in the USA has received a check either. Not one so far!泭 It is not a conspiracy!泭 The government does not magically press a button and checks泭 go out.泭 It is a process. It will happen for the majority of Americans who meet the requirements. Put on your mask on and breath deeply. Relax. You will get your check.

My cousin who lives in Thailand on less than $1,000.00 USD Social Security monthly and doesn't file taxes had his payment deposited to his credit union in the U.S. yesterday.

Actually he will not.泭 The bill was written specifically to exclude persons who had a spouse file with an ITIN.泭

"Mixed-status families, where one spouse has a Social Security number and the other has an ITIN, might wonder whether they will get stimulus payments. Unfortunately, due to a quirk of the law, not only will the ITIN holder not receive a payment, their spouse wont either, if they are married filing jointly. The same is true if both spouses have Social Security numbers but claim a dependent with an ITIN."泭 泭 This is a legal advice site and not government but it seems to be authoritative.泭 I suspect that some anti-immigrant Congressmen were looking to exclude what they call "mixed status" families and 做厙輦⑹s got caught in the crossfire.

Here is good news for married 做厙輦⑹s in the "grey lady" on the new round of stimulus checks.



"What if Im a citizen married to someone who is not and uses an Employer Identification Number instead of a Social Security Number?

In the spring, that usually meant that neither of you was eligible for payments. Now, when two people are married and filing their taxes jointly and only one spouse has a Social Security number, they would be eligible for a single $600 payment. Each of their children with Social Security numbers would also be eligible for the $600.

This change would be retroactive, which means that you could use your 2020 tax return to claim the payment that you did not get in the spring."

"What if I still havent received my previous stimulus payment or only got part of it?

You can claim what is known as a recovery rebate credit when you file your 2020 tax return. The Internal Revenue Service has a page on its website that explains the details."

This should be a real motivator for those who haven't been bothering to file taxes.
