Applying for Single Permit - Which Competent Region?

rosieallison95

Hi all,

I am a Brit currently living in NL (I moved here pre-Brexit). I have bought a house across the border in Belgium (Flanders) with my Flemish partner. I work for a company that works 100% remotely, but is registered under Belgian law (so is in practice a Belgian company). The head office (although no one works there) is in Etterbeek, Brussels.

When we try to complete the application form for a Single Permit, it asks to enter the PLACE OF WORK. Because I will be working remotely, this will be my new house in Flanders (Lichtaart, Kasterlee). But this house is not legally under my name yet until we sign the final agreement, which could take months. The other option is to enter the Etterbeek office of my company as the work address (although I will not work there in practice). This means that the 'competent region' of my application will be Brussels, even though I want to live in Flanders.

So I have two questions: 1) Is it an issue if the competent region of the single permit application is different from the eventual residence address? E.g. in my case - competent region = Brussels, place of eventual residence = Flanders. 2) Is it an issue if I enter a teleworking address that I do not officially own yet? Will this be checked by the authorities dealing with my application?

I'd love to hear if anyone else has had a similar issue. I cannot be the only person wanting to 'work'  in Brussels but live in Flanders!

Thanks very much for you help.

Hi again,

The competent region is where your company is based, not yourself. If your company is registered in Flanders, then they will send your application to the region of Flanders. That's what I understood from going through the process with a company that was hiring from abroad for the very first time (so we had to figure out a ton of things together).

Good luck with the application!
