eligible for Permanent residence card ?

Hi,
I have following situation...
I am employed with IT Indian company on °µÍø½ûÇø contract. That's why even after working 5 years my PR application is rejected by commune.
But My spouse has completed 5.5 years in Belgium and working for local Belgian company for 4.5 years. She came with me as dependent but after some time she found a job in local Belgian company. She also got her status change from dependent to independent in the commune. Now I would like to know
if my spouse will be eligible for Permanent residence card ??..
and Which Permanent card will she be eligible B or D?
If she get permanent card then Will her spouse and kids be eligible for Permanent residence?
Any advice will be usefull.

When did your wife change the status from dependent to independent?
The time counter starts again once status is changed. So check that she has completed 5 years after the change.

You both will have to send individual files for the PR card.
Thus, just because your wife gets the PR card, does not mean you will be eligible for getting the PR card as well. You will yourself have to completely 5 years with a local company (new rule?!).

For minors, its different and generally they are eligible. Best to check with the commune.

If her current card is about to expire and she has completed 5-years, she will get a B-Card (BE Permanent Residency). But if the current RP is valid for a longer duration, the commune will not allow her to change her RP to a B-Card, unless the current RP expiry date comes close.

In such cases, you can apply for a D-Card (which is EU Permeant Residency).

Hi,
You can apply for B, if you have finished 5 yrs of stay, eventhough your A card has validity. You dont have to wait for your next card renewal.

If you have worked and you have 5 yrs of pay slips, please apply for card D rather than B.

You can no longer apply yourself for B-type PR, unless your single permit validity is coming to an end. Atleast this is now a rule with Zaventem commune. They will not take new applications of B-type visa unless the RP is about to expire and 5-years have been completed.

However, like you mentioned, one can apply for D-type PR, irrespective of your single permit validity.

It’s my mistake.

I applied D and thought the same is applicable to B as well.

Hi all, good news my spouse have received the D Card. But I am not sure if I will be eligible for permanent RP card. My details are following:
-Completed 5 years of continuous stay
-Working in Indian company from 5 years on seconded model (°µÍø½ûÇø)
My initial PR request was reject because I was on °µÍø½ûÇø model from last five years. But now since my spouse has got the D card. Will this change any thing for me? will I be eligible for B or D card?
Do I need to do anything to get B or D card? like become her dependent? or wait for another 5 years for PR :(

Continious 5 year in local contract and getting PR is not correct. do you have any link which states this?


Basically associate can work in °µÍø½ûÇø contract for 4 years and then move to local contract for more than 1 year to apply PR. during pR application Assocate should be in Local Pay roll contract and its not after completing all 5 years in local contract

I hope this is correct as this is also my case. I have same understanding that the is should work but I also heard (not 100% sure) that some of cases were rejected.
