Relocation to Malta but work for UK employer

Savvy1

Hi all
This is my first post and joining as this seems to be a knowledge rich forum.
So here we go.... I work for a UK employer and would like to spend the majority of my time in Malta. My employer has a new hybrid model for working in the office post covid and requires a 2 day week min in the office. I have agreed with my manager i can condense this and work 8 days straight and the rest of the month i can "WFH". It is the reminder of the month which i want to live in Malta and here i guess lies the issue as I'd be breaking the 183 day rule for residency and therefore be liable to pay income tax there.
I am new to all this but was looking at possibility being a non dom and therefore being taxed on a remittance basis. Here are the facts:
1. I was born in the UK and have lived here all my life.
2. My father was Maltese
3. I have dual Maltese and English nationality.
4. I have dual English and Maltese residency.

I want to be able to meet my employer's requirements and have as little implications to them as possible but also live more than the 183 days in Malta and remain legal.
Any pointers would be very much appreciated.

I dont think, as a maltese citizen, you can claim the non dom relief.

Suggest you talk to an accountant.

Thanks for that and I will.
Question though.... If I'm not registered for work in malta is there still a way the tax authorities will get wind that I am there?

@Savvy1

So you wish to avoid paying taxes. Bright idea telling everyone on an open forum.

Lol not at all but I'm obviously paying tax in UK and wanted to know the situation if i moved to malta. I assume its a matter of completing a self assessment return?

Get an accountant

Ask an accountant, people I know in this situation remains tax resident in the UK and pay taxes there.  No additional taxes here then.

Speak to an accountant. That’s what they did.

@Savvy1 This is relatively easy ... you need to apply for a digital nomad residency. see Identity Malta website.

I work here on the same basis as you are proposing...  i just followed the process and submitted documents.. you will need one clause changed in your contract potentially but identity Malta are clear on that stipulation..

any issues please come back to me and see if i can help..

There are no tax issues .. it is an agreed arrangement that bypasses schengen..  there are a few European countries using this residency method..

@savvy1 Definitely get a tax advisor involved. They way I see it you will be taxable in both Malta and the UK, but double taxation treaty rules will ensure you still only pay once.

@BaharRoss He can't apply for any specific residence scheme or any of the associated benefits as he's a citizen. Citizenship always beats mere residency.

But, unlike you, he is not an EU Citizen, he is a UK Citizen
