The easiest thing to do is live anywhere in the EU except the Netherlands. Europeans have the right to a family life so they can bring in their family without much restriction or cost.

The rule (EU directive 2004/38/EC) applies to every EU country except the home country of the EU citizen! So a Dutch person bringing a spouse to the Netherlands will have to do all of the normal immigration process/paperwork/costs. But if that Dutch person lived in say Belgium or Germany then they could bring in their spouse under 2004/38 very easily.

The EU's own website is quite clear on the info

Sorry but it isn't a law, it's an European directive. EU-countries have the freedom how they want to apply the directive.
The Dutch government has done this and yes you still have the right to join your family. However there are some restrictions made, but it's still possible.

Hi Members,I need some advice here please.

My 10 year old is a Dutch Citizen but lives with me in Nairobi Kenya. His Father is Dutch but relocated to Canada.

Qn: Am responsible for the Dutch citizen minor  in my country Kenya and I would love to travel to Netherlands with my Dutch citizen son and then apply for the Vilchez chavez Residence permit once in Netherlands.

Can someone please advice best how to procede with this process if in a similar situation? Thanks for your advice

Your son has already the right to enter the Netherlands since he is a Dutch citizen.

On the other hand you have to apply for a visa to enter the Netherlands.

You must have proof of income and you need a place to live so in other words you need a valued address in the Netherlands.

I understood that the father is relocated to canada so he does not have income income from a Dutch company or a valued address anymore which makes it more difficult, I got the impression you are separated at this moment is this right?

Just go to the Dutch embassy and request here is the link for what you need to provide:

Please do not hope that you can travel within now and six months because the procedure is take a lot of time and since we have so many people from other countries here the procedure can take for sure 6 months.

I do wish you can start your life in the Netherlands and all the best to you and your son.

Thank you so much Mr. Hank for your advice.

Am planning to book a hotel for two weeks which I can use as an adress where I will be staying and in those two weeks I can apply for the Vilchez chavez visa…my worry is someone else got rejected with the visa but I realised she didn’t provide enough documents and health insurance when applying but thanks again I will try .

Henk Jan Jansen

You are very welcome my dear, Booking a hotel will not get you in to the Netherlands specially if you want to request for a visa called mvv. The website is telling clearly what you need to do and to provide.

What you could do is to aks somebody in the Netherlands to help you out with a holiday visa and in the time you are here apply for a permit to stay and do not forget the passport of your son you have to bring this with you.

if you need more help you can always ask me.

I am normally work as a legal consultant for these type of requests, you can drop me a mail on my email if you like to see if I can help your further.

@Henk Jan Jansen

I will apply for the facilitation visa for parent of Dutch child under 18 not MVV and as such, the conditions don’t seem to mention taking classes

Henk Jan Jansen

If you requesting for a visa you need to do also integration course and do the first exam on the Dutch Embassy please keep this in mind (+ 3 months) it is part of the entire process when requesting for a permission to stay (MVV)
