TRP rejection for tourist visa

Hello I applied for a TRP as a dependent on my husband. We got a negative reason being a tourist visa. We have appealed within 14 days of the decision. I just want to know

1) Are we legal to stay till decision
2) Can I change to student TRP
3) what are the chances of positive decision. Because we applied before the rules changed.

Our lawyer says we are legal to stay in Warsaw till the decision arrives. But looking at the reversal rate I think it will take close to 6 months. We are looking for a true answer so we can plan accordingly.
