Ineligible for D8 Visa but Eligible for D7

Ben Kleinberg

Hi all,

My wife and I are looking at immigrating to Portugal either at the end of next year or early 2025. I have a remote job in the United States, but unfortunately, it fails to meet the income requirement for the D8 visa. I am aware of the D7 visa with its lower income requirements. My job definitely pays enough to satisfy that requirement for both my spouse and I. However, I have been seeing online that many D7 applications get rejected if the primary applicant has active income rather than passive income. I was wondering if SEF would make an exception if the primary applicant qualified for the D7 with active income but not the D8.

Any help would be appreciated.

Thank you!

Hi Ben, Welcome.

Before this digital nomad visa (D8/DR), which is new, remote workers used to apply for the D7 visa. All they had to do was have a stable, passive income from remote work.

I honestly don't know if the D7 visa still covers this option. I suggest you contact the Portuguese consulate near where you live.

@JohnnyPT Hi Johnny,

Thank you for the information. I will contact the consulate on Monday morning. I hope the news will be positive.

Thanks again!

No. We have consulted with lawyers on this already. I have passive income and the D7 now is absolutely ONLY passive income. No exceptions by law. Sorry.

@JohnNAnya Thank you, John,

This is disappointing, but we will look at other EU countries' digital nomad visas. I heard that Spain has one with a much lower income requirement.

Thanks again!

One more quick question. (I assume the answer is net income, but I just wanted to be sure.)

When you apply for the D8 visa, when analyzing your income proof, do they look at net income per month or gross? Again, I assume it's net, but I know some countries look at gross, so just wanted to make sure.

Thanks!
