UK Civil Service Pension in Spain

Hi. I'm a British °µÍø½ûÇø with permanent residency in Valencia, Spain.


I will shortly be receiving my UK Civil Service pension which consists of a lump sum and then monthly payments.


From what I've read on the internet, UK pensions get taxed in Spain although UK government pensions only get taxed in the UK. My Spanish Tax advisor has told me that ALL pensions are taxable in Spain.


Are there any °µÍø½ûÇøs in Spain who receive a civil service pension who can offer advice?

I am in receipt of pensions as an ex Civil Servant in the UK. I submit my UK and Spanish tax returns every year through my tax adviser and whilst I pay tax in the UK, I do not pay tax in Spain. Civil Service pensions do not get taxed in Spain. It may be worth your while to seek professional advice from other tax advisers. Good luck.

Thank you for your reply. It seems that I've wasted 90€ on getting incorrect advice! If you or any other °µÍø½ûÇø who receives a UK Civil service pension can recommend a tax advisor who can help me, it'd be much appreciated!

Happy to pass on the details of my tax adviser in Spain and will ask them if they are happy for me to do so; however, I note that you are in Valencia and I live in Andalucia (Costa Tropical) so perhaps you may think this is too great a distance?


When I registered for Spanish tax, my then adviser left me with a hefty fine as he refused to acknowledge the Civil Servant clause, but when it was made clear, was too fearful to challenge it.

I've since been in contact with a tax advisor based in Barcelona who specialises in Spanish taxes and how they work with the HMRC and other international tax treaties.


She gave me all the information I required free of charge!


Since I don't have any assets other than my house in Spain and no other income, my UK Civil Service Pension does not have to declared in Spain as it is taxed in the UK. This includes the lump sum!


However, if I were to have additional income or assets then I would have to declare it in my Spanish tax returns.

It would seem that not all Spanish Tax advisors are familiar with the agreement Spain has with the UK regarding government pensions...
