Legal questions

Mayis231

Hi there

Just looking for legal advice, my son was born in Canada the baby daddy is in Turkey, we have been separated 3 years, he lives in Turkey I live in Ottawa Canada.

If my son was born here an if I live in Canada can I go visit Turkey with my son, if I do do my ex inlaws have rights to my son?

Does it matter whether I’m divorced or not on who gets custody of my son? If I come to Turkey with my son as a divorced woman do I lose rights to my son?

Do I lose my citizenship duel citizenship if I get divorced?

What are my rights? What rights do my in laws off? If I come to Canada with my son can they report me?

hi there i am not a lawyer and i cant give you any advice but since you asked this is my take
, there is a child involved in this situation the father  can fight for the custody ,you did not mention the age of your child assuming he is not a legal age so he can't have a say in this matter but he is a canadian citizen ,and subject to canadian laws ,but when it comes to custody battel, no matter what the law says it takes months even years not to mention lawyers fees  to settle the child custody ,overseas
specialy turkey ,i wouldn't risk it , wish you all the best  still i consult  with a attorney in family law.

Hello,
From your message it is not clear whether you are still married with your husband or you are oficially divorced with him. If you are oficially divorced, usually the divoce judgment contains a provision on the custody of the child. If you have the custody, noone can take the child from you. So your ex husband will not have a legal right as taking the child.

If you have dual citizenship, the divorce procedure does not effect your nationality.

And god forbid if your husband tries to take the child by force or somehow different this may fall into the procedure of International parental child abduction (which is a UN convention).
