legalization process after childbirth as an illegal

Hi there,


does anyone have experience with the following situation and can give me some advice concerning the steps to take?


I am livig in Brazil with my family and we have been overstaying for almost 1 year now. Soon my wife will be giving birth to another child, which means we will have a legal claim for permanent residency then - since the child will be born in brazil, and therefore it is brazilian.


Still the problem is that we are currently illegal in the country. What is the best way to resolve that situation?


Is it basically possible/better to do the legalization process from within the country? If so, which steps are necessary?

Or might it be better to leave brazil after giving birth, pay the fees, wait for 180 days (entry ban), resolve everything through the brazilian embassy in our homecountry and finally come back when everything is done?


Maybe someone already lived a similiar situation?

01/11/23 @Fred_K1.  My strong suggestion would be to find an attorney whom you feel you can trust and seek professional advice on how to regularize your situation.

Do not go out of the country. You will be in bigger trouble. Take the birth certificate and apply for your residency. Keep all the papers ready before hand. Its easy.
