Re-entering Brazil with unregistered Nomad Visa?

seriouscatsoserious

Hey all! Quick question

  1. Entered Brazil in January with a valid Nomad Visa
  2. Made appointment to see PF in March (first available)
  3. Went to appointment and was told I needed to get the paperwork fixed for errors the consulate made
  4. Got those fixed
  5. Set another appointment, first one was outside the window of 90 days to register and presumably get RNM
  6. I have a work trip I need to leave the country for in a week
  7. Will return in June

My question is: how screwed am I? I have a lawyer friend who is not an immigration lawyer but pulled a little jeitinho brasileiro move and went to PF with me wearing a suit. Supposedly they will just fine me he said but, I'm dubious.

Anyone know if there's any discretion at the border in this scenario, especially if I have the edited documents with official government stamps, dated papers from when I first went to PF and they told me what to do (with instructions written)?

Thanks

@seriouscatsoserious I will be as positive as possible. First of all, get a real Immigration Lawyer who has actually done this before. I spent thousands of dollars and over 6 months with one that was not a REAL Immigration Lawyer. Second, watch your calendar. They will definitly watch it as you come in and leave the country, even to the point of making sure you have enough time on your visa to do what you say you are going to do. Also do not confuse ''Doing'' with ''Done'' An appointment outside of the time frame to process your visa is not the same to them as actually having the visa.

Good Luck

05/12/25 @seriouscatsoserious. I want to make sure that I have the facts absolutely straight, so please correct anything in my restatement that's incorrect:

  1. You have a Digital Nomad visa that's still valid, and will still be valid when you return from your trip
  2. You had your initial appointment with the PF, and they told you to get some of your documents corrected
  3. You followed their instructions and set up a follow-up appointment to present your corrected documents; the earliest available appointment is and June, so that's when you scheduled it.
  4. You have to be out of the country for reasons unrelated to Brazil but you'll be back in time for your scheduled appointment.
  5. You visited the PF with (a person who was effectively) your lawyer, described the situation to them, and they told you both that you should be able to complete the process when you come in for your scheduled appointment.

The Immigration Officer at the airport does have a lot of discretion in whether or not to admit you, but if I've stated your situation accurately, you have a valid visa to enter Brazil, you have an appointment scheduled to complete your registration process and to present the corrected information that the PF requested, and you and your lawyer were told by the PF at your meeting that they'd continue your processing at that time. There are no guarantees, but on that basis I think that the Immigration Officer should admit you. The fact that you also have the PF instructions and the required documents should be helpful, if s/he has additional questions. In your place, I'd come and expect to be admitted.

Best of luck. Please let us know how it goes.

This happened to my wife many years ago - my first card arrived in timely fashion, but her's was delayed, and we had to return to the UK for 2 weeks. The PF gave her a signed and stamped note before we left, that confirmed the situation, and stated that she was allowed to re-enter. When we came back, she presented this instead of her card, and there was no problem.

Maybe you should go get a similar letter (with your attorney?) from the PF before you leave...

@Peter Itamaraca

I did this, they wouldn't give me anything

@abthree

Yes everything you've stated is correct

@seriouscatsoserious

I was using an immigration attorney, with experience of dealing with the PF - maybe that made a difference?

@Peter Itamaraca It did! I used a Pretender, and it cost me much money and six months.
