Residency Restrictions for US Registered Sex Offender

My Nomdeplume
So I know that I may receive some hate for this so allow me to explain the full situation up front. When I turned 18 my parents began a very nasty divorce, My mother took my two younger sisters and I chose to stay with my dad. About a year into the custody hearings my mother and sister decided that it may make for a home run case if my sister made a false claim that she did not want to live with my dad because I had sexually assaulted her. this led to a 3 year long court battle during which I made several bad life choices one of which included trying to bury my depression and shock at the betrayal with drugs and alcohol.

In 2013 I followed the poor advice of a cheap attorney to just plead guilty and receive 10 years of Deferred Adjudication Probation. During which I would have to register as a Sex Offender. I was told that because of my drug use I would not stand a chance of winning my defense no matter the lack of evidence. I am on the last year of my Deferred Adjudication. If you are not aware of what that means, It means that once I am done, there will be no Felony Conviction on my record, I will still show that I was arrested for this charge, and I cannot get that expunged.

During these last 9 years, I have been sober, grown my own personal business, and even met the woman I now call my wife. My entire family (excluding my mother and the one sister) have a very good relationship. My wife and I have decided that we wish to °µÍø½ûÇø, she works in telehealth as a Licensed Counselor, and wants to live in Ecuador. I lived there in 2009-2010 for 8 months. I have reached out to one law firm based in the US that specializes in Ecuadorian Visas and they said they could not help me. I am wanting to know what I can do to appeal for citizenship, and how long in advance should I do this. My wife and I have decided we want to make the move in the next 5-8 years.

I know that this is a very specific circumstance, but this site seems to be a great source of information and I am hoping that I can glean some decent starting off points and or opinions on the matter. I understand that many of you may have a negative opinion of me due to the nature of my charge, you may think of me as a flat out liar or a sicko. There is nothing more I can say on the matter other than the facts, and that's all I ask in return, the facts regarding entering and moving to Ecuador as someone with this type of background. Thank You.

The places we have looked at would be Ibarra, Cuenca or Quito. My wife would still be bringing in an American Income and would be applying for Duel Citizenship. So I would also like to know how that works (receiving foreign income and living in Ecuador). I would be continuing my own Drone Piloting business there and looking to denounce my American Citizenship and become a full time Ecuadorian Citizen.

Although I have zero knowledge of the technical aspect of your post, I just want to say that I believe in compassion and respect to one another. I believe that love is always the answer and if we are just a little more kind to each other we can make this a better place. I’m happy to know you have your wife and things have been looking up for you. I only wish you luck and hopefully you can get things sorted out, ecuador is an amazing place!

Run your background check with the FBI when the time expires. See what remarks are on it.
Run your state level background check too.

In my experience, migration only goes by what it says on the apostilled paper in front of the agent checking your case.

They don't dig deeper. They don't have the care time or resources.

If you have negative remarks, don't sweat. Find a lawyer **in Ecuador**. They'll hopefully have a solution for you.

Also a lot can happen in upcoming years. The visa rules are modified every year.

@My Nomdeplume dude look at getting a expungement or pardon, you will likely get it and depending on where you live.. Ask a lawyer in your state.. sounds like you would be a perfect candidate .. most of this seals the records so no one can see it. you want to do this ASAP.. criminal background checks only go back 7 years and since its been 9 years you shouldn't show up on background check. you want to get the expungement or pardon it will just be the best route
