Eligibility for permanent residence D card

Hello All,

I am a non EU citizen living in Belgium since mid 2017, currently in Flanders. I am here as a dependent to my spouse ( Who Is deputed here and holds a Single permit). I have been working with a full time local contract for over a year.
My understanding is: As per the new law passed in Oct 2020, my husband is not eligible to apply for permanent residence after 5 years as long as he is deputed by the foreign company.
But, am I eligible to apply on my own for permanent residence after 5 years of stay as dependent..If so, what are the criteria that I should meet. (I have done the social integration course, attained A2 level in French and pursuing A2 in Dutch Would have worked 2 years by the time I apply..)

Any pointers or prior experience is appreciated.

May be you can ask for B. For D, you may need to submit payslips for 5 years.

You can do one thing, take the advantage of email.

First send a mail asking for card D appointment and necessary documents to bring. If they ask for 5 years pay slips you don’t qualify for D.


Later ask for  Card B appointment and necessary documents. If I remember, you can ask for card B by email without even submitting any documents.

Hi I have similar situation...

Need advice if spouse of D or B card holder will be eligible for Permanent residence card??...if he has completed the 5 years on °µÍø½ûÇø contract with Foreign company.

Also my spouse apply for D card in Commune but even after 5 months commune is not replying on the status of card...She has completed 5.5 years in Belgiam and working for local Belgian company for 4.5 years.....Can we approach some place legal advice.?

For D card SLA is 5months, no response till 5months mean it should have been approved by default, you should approach commune and ask for your card, btw when did you submitted your application ? Thanks

I saw you guys talking about time period. So Just keep in mind due to covid the time frame has been extended for everything.

For example i appiled for my citizenship. Normally decision time is 4 months. But it got extended to 6 months and i got the answer in 7th month.

But it is true if you cross your decision period normally its a good sign. Approach your city hall. They will guide you. 😊
