Can we work on MVV ?

Hello,

My company would be applying for a Highly Skilled Migrant visa as they are a registered sponsor. I have a Belgian residence permit and therefore I would not be needing an MVV to make my first entry in the Netherlands.

I wish to work as soon as possible (possibly the day I arrive in the Netherlands, otherwise I could not be eligible for the 30% ruling)

My question is: In case my application is approved, can I directly start working from the day I arrive in the Netherlands, or do I need to wait until I get my residence permit after my arrival.

In case I opt to get an MVV, would I then be allowed to start working from the day I arrive in the Netherlands. I know if I opt for MVV, IND would also endorse a residence sticker on my passport that would be valid until I get my residence permit but I am not sure I could use it to start working from the first day itself.

Any help in this regard would be greatly appreciated.

Hi again.

You can only apply for 1 visa, so either a HSM, or an MVV, you can't have 2 applications going at the same time.

You need to contact the Gemeente within 5 days of arrival in the Netherlands to make your appointment to register and get your BSN; most people make the appointment over the phone, but you can call in and do it. I mention this as people have told us that it has taken up to 5 weeks to get an appointment and Covid will not have improved things. In the meantime, you can begin working while you wait for your appointment. What you can't do without a BSN number is register with a doctor, open a bank account, pay your taxes, register your car, so the sooner you can get register, the quicker you can get the things done to make your life easier. So make sure your medications are up to date and enough to last you.

If you have a Belgian residence permit are you living in Belgium?

If you live in Belgium for more than 16 months in the last 2 years you won't be able get the 30% ruling because I don't think anywhere in Belgium is over 150km from the Dutch border so do check that as well.

Thanks for your response. I lived in Belgium for less than 8 months (7 months and 23 days to be precise) in the last 24 months. Presently I am in India and still working with the Belgian company and planning to move to the NL just one day prior to my first working day so that I still comply with the 150 km requirement. I still have a valid Belgian residence permit though which expires in Oct of this year. I think it would be automatically revoked once I get the NL residence permit.

I have the evidence like the air tickets, passport entry/exit stampings, phone bills, etc. to prove my stay outside of Belgium.

Would possession of the Belgian residence permit has any implications on approval of 30% ruling. My assumption is you need to be physically present in the country and the residence permit is not taken into account.
