Renew pre brexit residency

Hi, our pre brexit residency has 5 months left to renew, we are looking for some land/property around Monsaraz, we need to book a renew appointment, but now have no address, does anyone know if a camp site is acceptable, we are in our motorhome and there are absolutely no rentals available in the area.

We were trying to find something for about 3 months.

Regarding land, you must select "Urbanizável".

"Não urbanizável" means you can't build there anything.

Ok thanks Johnny, at least we know where we stand, nothing worth  renting anywhere whilst we search, and don't want to risk not being extended, looks like it's Spain for us, what a shame, we were loathed to give up our pre brexit agreement.

Not sure if we are in trouble anyway, we have not spent over 2 months a year in Portugal during or 5 years due to sick mother in law, so have not filed any tax returns, and have paid UK tax on our 36k income.

Is this going to be an issue do you think if we go into the SEF to renew. Lol

Your Certificate of Registration for an EU national, which is what you'd have been issued with pre-Brexit, is not the same thing at all as a residence permit and therefore doesn't have the same conditions with regard to validity, renewal etc.


In the case that you had actually resided in PT after its issue, you would have been eligible to exchange it for a post-Brexit residence permit, confirming and guaranteeing all your rights as set out in the Brexit Withdrawal Agreement.


In the case that you weren't livng here at the end of the Brexit Transition Period, or weren't within the allowable absences criteria to be regarded as continually resident, you wouldn't be eligible to make a late claim for such an exchange. It might be possible for someone who fulfilled the criteria but had omitted to get either the original certificate of registration or effect the exchange but the burden on them of proof of residence would, I suspect, be quite high, to say nothing of the possible implications for any other administrative omissions.


In your circumstances, it appears to me that your only route to residence would be to return to the UK and make an application for the relevant visa from there.

I have an NIF and Certificado De Registo De Cidadeo DE Uniao European.. Issued may 2019 for 5 years.

Does this tie in with what you are saying..

In response to both of the above :


The issuing of a CRUE just means that you requested - and were granted - an official document attesting to the fact that, at that moment, you were exercising your rights of free movement as set out in the EU Treaties. It doesn't mean that you have special rights conferred as a result of having been issued that certificate. Those rights exist (or existed, in the case of the UK) regardless. You couldn't, for example, have been removed from the country if you didn't have said certificate solely for that reason, although you could have been fined for not obtaining it (I have yet to hear of anyone who has been, though)


You can obtain a NIF as a non resident. If you have a NIF, you're required to inform the tax authority, within 60 days, of any change of address or residency status. It's not wise to have a NIF registered to a PT address unless you're actually resident in Portugal. You can check the address you've given as your fiscal residence on the Finances portal, assuming you've registered for online access.


You say you've been offered an interview for "renewal" of this certificate. It's not a renewable thing - you either, as an EU citizen, voluntarily exchange it for a document attesting to your previous 5 years' residence, renewable at 10 year intervals, or, as we UK citizens now find ourselves to be non-EU citizens, exchange it for a new document, attesting to our previous residence and the fact that we have protections under the Brexit Withdrawal Agreement, assuming we fulfill the eligibility criteria to obtain it (those would imply actually having been resident here for some time, as opposed to simply having requested and been issued a certificate of residence 5 years ago).


Good luck to you if you can obtain a residence permit - either a Brexit WA card based on the CRUE or a new one from an application lodged in-country - on the strength of what you've said so far. I certainly wouldn't be the sort to get all sanctimonious about whether you should or shouldn't have it. But from what you've said, you don't actually qualify to apply from within PT and ought to start from scratch from outside PT.

Many thanks for your detailed response, we just didn't understand anything at all, we were also worried that we might be in trouble for not filing tax returns, even though we do pay uk tax, given the above I think we will probably go down the Spanish Non Lucrative route, we meet all the criteria for that, although a bit of a rigmarole.

We have health numbers for Portugal, I wonder if it just all runs out naturally with our certificate.
