Card L Brussels

Hello,


I have been legally residing in Belgium since January 2021. I understand I can apply for the permanent residence card (Carte L) after 5 years, which will be in January 2026.


However, my municipality (Brussels 1000) invited me to apply early in May 2025, and I submitted the application even though I still have 8 months left before meeting the 5-year rule.


I also hold an unlimited work permit and am married.


Could you please advise:

    •    Is it possible my Carte L will be approved before completing 5 years?

    •    Does my work permit or marital status help?

Thank you for your answer. Why do you think they invented me even I have requested an appointment to renew my A card (currently I don’t have renewal application for A)

This is quite a strange situation. Normally, the L kaart  is only approved after completing 5 full years of legal residence.


Maybe you were legally living in Belgium before January 2021 – for example, as a student? In that case, part of that time can also count (at 50%), and the commune might be correct to invite you earlier.


Or maybe the commune is just collecting your documents now, but they will only send your application in January 2026, when you officially reach 5 years? But I've never heard of such generosity.


Otherwise I agree with previous member - your application will likely be rejected by DZV due to the insufficient legal residence time.


As for your work permit or marital status: Your unlimited work permit does not change the 5-year rule.


Your marital status also does not help you directly,  it’s only important for your spouse’s residence rights, not yours.

Unfortunately they don’t hold responsibility as they just transfer your documents …

Thank you for your answer. I haven’t been in Belgium before, and I can only mention that I started working within Belgian employer three months before I moved here. Also, the commune responded to my A card renewal request with L card appointment, so they only processed the L and ask me to request for annex 15 before one week of my current A card. Complicated!!!

when they offerred you to apply L card, that means they will accept it


My friend was termited after 4,9 years of working. He had to go back to his country, after several months he had the offer of new job and cameback, and they also offerred L card (1000)

Sounds like the law is left subject to interpretation. However, it is not counted as interruption of legal residency to be outside of Belgium for less than 6 consecutive months.
